Registration of establishment employing migrant workmen under The Interstate Migrant Workmen
The Interstate Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979, commonly referred to as the “Interstate Migrant Workmen Act (IMW Act)”, aims to regulate the employment and conditions of service of interstate migrant workers in India. Here’s an overview of the registration process under this Act for establishments employing migrant workers:
The IMW Act applies to every establishment or contractor who employs five or more interstate migrant workers (IMWs) during the preceding twelve months. An interstate migrant worker is defined as a person who is recruited by an employer in one state for employment in an establishment in another state.
Once registered, employers or contractors must comply with various provisions of the IMW Act, which include:
- Providing interstate migrant workers with fair wages, suitable accommodation, medical facilities, and adequate protective measures.
- Maintaining records and registers of interstate migrant workers.
- Submitting periodic returns and reports to the registering officer or the Labour Department.
Registration ensures that the employer or contractor operates legally under the provisions of the IMW Act. It provides a framework for safeguarding the rights, welfare, and safety of interstate migrant workers. Registration helps in regulating the recruitment and employment practices involving interstate migrant workers, preventing exploitation and ensuring fair treatment.
